Strengthening the expert determination process
Expert Determination (“ED”) is a binding dispute resolution process whereby both parties sign up and agree to have issues in dispute determined by a suitable expert. It is a contractual process. It can be agreed in contract documents prepared before a dispute ever arises or can be later agreed to settle a dispute. It is most appropriate where the issues are not issues of law but are issues that a technical expert such as an accountant or surveyor can determine.
